1. Who you are contracting with
Living Resume is operated by Keith Wagner ("we", "us", "our"), trading as Living Resume. By creating an account, purchasing, or continuing to use the service you agree to these terms. If you use the service on behalf of an organisation, you confirm you have authority to bind that organisation. If you are an individual, you confirm you are of legal age to enter a contract.
2. What the service does
Living Resume turns the career information you provide into a shareable page with an AI assistant that answers visitor questions about you. Answers are generated from the résumé details, written answers, and quotes you supply. You are responsible for the accuracy of that information and for keeping it up to date. You must keep your login credentials confidential and are responsible for activity under your account.
3. Acceptable use
You must not:
- use the service unlawfully or for fraud, spam, or misrepresentation;
- upload content you do not have the rights to, or that infringes anyone's intellectual property, privacy, or publicity rights;
- impersonate another person or publish a page presenting someone else's career as your own without their permission;
- interfere with the security or integrity of the service (malware, probing, scanning, scraping, circumventing usage limits or technical restrictions);
- reverse engineer, resell, or redistribute the service.
4. AI-generated content
Answers are produced by an AI system and may be incomplete or inaccurate. You are responsible for reviewing your page and the answers it gives, for the prompts and content you submit, and for how you and your visitors rely on outputs. The service is not a source of legal, financial, medical, or other regulated professional advice. We may filter, restrict, or remove content and refuse or moderate outputs, and we act on rights-holder complaints — repeated or serious infringement leads to account termination. 5. Intellectual property
We retain all rights in the service, including its software, design, documentation, and branding. You are granted a limited, non-exclusive, non-transferable right to use the service within the plan you have purchased. You keep ownership of the content you upload and grant us a limited licence to host, process, and display it solely to provide the service.
6. Payment, billing, and subscriptions
Our order process is conducted by our online reseller Paddle.com. Paddle.com is the Merchant of Record for all our orders. Paddle provides all customer service inquiries and handles returns.
Payment, billing, tax, cancellation, and refund mechanics are governed by Paddle's Buyer Terms. Living Resume is sold as a one-time setup fee that includes a number of visitor sessions, plus optional prepaid session packs. There is no recurring subscription and nothing renews automatically. Prices are shown before checkout and exclude taxes where applicable. When your session balance reaches zero, your page remains readable but the AI assistant pauses until you add more sessions.
7. Service level
We work to keep the service available but do not guarantee uninterrupted or error-free operation. To the fullest extent permitted by law we disclaim all implied warranties, including merchantability and fitness for a particular purpose.
8. Suspension and termination
We may suspend or terminate access for material breach of these terms, non-payment, security or fraud risk, or repeated or serious policy violations. You may stop using the service at any time. On termination you may export your content for 30 days, after which we may delete it.
9. Liability
To the extent permitted by law, our aggregate liability is limited to the fees you paid in the 12 months before the claim. We exclude liability for indirect, consequential, or special damages, including lost profits, data, or goodwill. Nothing excludes liability for fraud, death, or personal injury caused by negligence where the law does not allow it. You indemnify us against claims arising from your content, your unlawful use of the service, or your breach of these terms.
10. General
These terms are governed by the laws of the State of South Carolina, United States, and its courts have exclusive jurisdiction. You may not assign your rights without our consent; we may assign ours in a merger or acquisition. Neither party is liable for delays caused by events beyond its reasonable control.
